Honorable members of the International Criminal Court,
At the dawn of Monday, May 31st 2010, the Israeli armed forces launched a mortal commando attack on a flotilla of six protest ships that had been trying to get aid supplies through to the besieged Palestinian Gaza Strip. The ships were navigating through international waters by the time of the raid, which resulted into the killing of twenty people and wounding dozens of others, thus violating the provisions of international law that incriminate assaults on members of voluntary organizations and protect the employees of relief organizations from neutral country(ies), the job of which is giving aid supplies to devastated civilians in conflict areas. The same laws give immunity to members of relief personnel from the countries that are parties of the conflict.
The assaulted flotilla is applicable to the legal provisions that clearly dictate that it is:
• recognized by the government of the neutral country(ies).
• expected by the aid-beneficiary party of the conflict.
• legally reported to both parties of the conflict.
The Israeli attack also violated Protocol I of 1979 and Article 9 of the 1949 Geneva Convention, which constitute no obstacle to the humanitarian activities which the International Committee of the Red Cross or any other impartial humanitarian organization may, subject to the consent of the parties to the conflict concerned, undertake for the protection of wounded and sick, medical personnel and chaplains, and for their relief.
Consequently, I demand that you take the necessary actions to charge the Israeli government with the attack on the Freedom Flotilla, and bring to justice whomever made the decision, executed the operation and anyone else who helped to carry it out.

في فجر يوم الواحد والثلاثين من مايو 2010 قامت القوات الإسرائيلية بمهاجمة سفن قافلة الإغاثة”قافلة الحرية”المتوجهة لمدينة غزة الفلسطينية في المياه الدولية ,مما أسفر عن مقتل حوالي 20 شخصًا وإصابة العشرات الآخرين ,وهذا بالمخالفة لما جاء في نصوص القانون الدولي من تجريم للاعتداء على أفراد الجمعيات التطوعية ,حيث يضفي القانون الحماية على موظفو جمعيات الإغاثة التابعون لبلد/بلدان محايد والذين يقومون بتقديم المساعدات الإنسانية في مناطق النزاع ,ويضفي القانون عليهم نفس حصانة رجال الإغاثة التابعون للدول الأطراف في النزاع
:والقافلة المُعتَدَى عليها تنطبق عليها الشروط القانونية التي تنص على أن تكون
.مُعتَرَف بها من حكومة الدولة/الدول المحايدة -
.موافقة طرف النزاع المستفيد من المساعدات -
.علم أطراف النزاع بذلك بشكل رسمي -
وبالمخالفة كذلك لما نصت عليه اتفاقيات جنيف من أن”في حالة نقص المؤن الكافية لسكان الأراضي المحتلة ,وجب على دولة الاحتلال السماح بعمليات الإغاثة لصالح السكان المدنيين ,وأن توفر لهم جميع التسهيلات كالمشاريع التي تقوم بها حكومات محايدة أو منظمات إنسانية”
وبالمخالفة كذلك لاتفاقية جنيف لسنة1949 والبروتوكول الأول لعام 1979 والذي ينص على أطراف النزاع أن يسمحوا-بل ويسهلوا-المرور”السريع”وبدون إعاقة لإرساليات وتجهيزات الغوث والعاملين عليها ,المرسلة للسكان المدنيين حتى ولو كانوا تابعين للخصم
بناء عليه ,فإني أطالب سيادتكم بتحريك المساءلة الجنائية بحق المسئولين الإسرائيليين عن ذلك الاعتداء على قافلة”الحرية” ,سواء من اتخذوا القرار أو نفذوه أو ساهموا في تطبيقه
